1. Scope of Application
These General Terms and Conditions (GTC) govern all business relations between Andreiver, owner Andrei Haldukevich (hereinafter “Andreiver”) and its customers. By booking a trip, the customer accepts these GTC as binding. Deviating terms and conditions of the customer shall not apply unless Andreiver expressly agrees to their validity in writing.
2. Conclusion of Contract
The presentation of services on the website does not constitute a legally binding offer. A contract is only formed when Andreiver accepts a booking request via a confirmation e-mail or written confirmation. Andreiver is not obliged to accept a booking request.
3. Booking
Bookings can be made via the website, e-mail, or telephone. The customer is obliged to provide complete and correct information at the time of booking, in particular:
Name of the client
Pickup and destination address
Date and time of the trip
Number of passengers
Number, type, and size of luggage
Need for child seats
Flight number (for airport pickups) Incomplete or incorrect information may lead to the adjustment or rejection of the booking.
4. Vehicles Andreiver provides premium or executive class vehicles, in particular vehicles of the Mercedes-Benz brand. Andreiver reserves the right to provide an equivalent vehicle for technical or organizational reasons.
5. Luggage The customer is obliged to correctly state the number, type, and size of luggage when booking. If the actual amount or size of luggage deviates significantly from the data provided during booking, Andreiver is entitled to refuse carriage or provide a suitable vehicle at an additional charge. Any resulting additional costs shall be borne by the customer.
6. Prices and Fixed Price Agreement The price stated in the booking confirmation is considered a fixed price for the agreed route and duration. All prices include the applicable statutory VAT. Additional costs may arise if changes occur at the customer’s request, in particular due to:
Additional waiting times
Intermediate stops
Route changes
Extension of the booked trip duration
Significantly deviating luggage quantities Only the price in the booking confirmation is decisive.
7. Waiting Time Complimentary waiting times:
Airport pickup: 45 minutes from the actual landing of the flight, provided a valid flight number was given.
All other pickup locations (e.g., hotel, station, address): 15 minutes from the agreed pickup time. After the complimentary waiting time has expired, every started 30-minute waiting period will be charged additionally according to the agreed hourly rate. The driver is not obliged to wait longer than the agreed complimentary waiting time.
8. Flight Monitoring
For airport pickups, Andreiver only monitors the flight if the customer has provided a valid flight number during booking. If no flight number is provided, only the pickup time specified by the customer at the airport applies. In this case, Andreiver assumes no responsibility for flight delays or changes in arrival time.
9. Customer Delay / Reachability
The customer is obliged to be reachable by telephone during the agreed pickup time. If the customer is not reachable at the agreed time or does not appear at the agreed pickup location within the complimentary waiting time, Andreiver may treat the order as a No-Show.
10. No-Show
A No-Show occurs if the customer or passengers do not appear at the agreed pickup location within the complimentary waiting time or if the customer is unreachable. In this case, Andreiver is entitled to charge up to 100% of the agreed fare. For airport pickups, an order is considered a No-Show if the customer does not appear at the agreed meeting point 45 minutes after the actual landing of the flight.
11. Cancellation by the Customer Free cancellation is possible for:
City and Airport Transfers (Transfers): Up to 4 hours before the agreed pickup time.
Hourly Bookings, Long-Distance Trips, and Day Trips: Up to 24 hours before the agreed pickup time. If the cancellation occurs later, Andreiver is entitled to charge up to 100% of the agreed fare as a loss-of-use fee. The customer reserves the right to prove that no damage or a significantly lower damage has occurred.
12. Exclusion of the Right of Withdrawal
A statutory right of withdrawal for consumers does not exist for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for fulfillment (§ 312g Para. 2 No. 9 BGB). Since the booked trip takes place at a fixed time, there is no statutory right of withdrawal.
13. Conduct of Passengers
Passengers are obliged to follow the driver’s instructions during the journey and to refrain from any behavior that endangers the safety of the driver, the vehicle, or other road users. Andreiver is entitled to refuse carriage or abort a journey already started if passengers:
Are heavily intoxicated or under the influence of drugs
Show aggressive or insulting behavior
Endanger the safety of the driver or other road users In this case, the claim to the agreed fare remains valid.
14. Smoking Ban
There is a strict smoking ban in the vehicle. This applies to cigarettes, e-cigarettes, electronic vaporizers, and all comparable smoking products. In the event of a violation of the smoking ban, Andreiver is entitled to charge the person responsible for the costs of professional vehicle cleaning as well as a loss of use.
15. Soiling and Damage to the Vehicle
In the event of extraordinary soiling of the vehicle (e.g., by drinks, food, vomiting, or similar contamination), the person responsible is obliged to bear the costs for professional cleaning and a loss of use. If a passenger causes damage to the vehicle or its equipment, the person responsible is liable for the repair costs as well as for a possible loss of use.
16. Routes and Intermediate Stops
Andreiver generally drives the fastest or most sensible route according to the traffic situation. Intermediate stops or route changes can be agreed upon at the customer’s request and may incur additional costs.
17. Liability
Andreiver has unlimited liability in cases of intent, gross negligence, and for damages resulting from injury to life, body, or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable, contract-typical damage. Andreiver is not liable for delays or failures caused by traffic jams, accidents, extreme weather conditions, force majeure, or official measures. Andreiver assumes no liability for missed flights, appointments, or connecting connections due to the traffic situation.
18. Liability for Luggage and Personal Items
Andreiver assumes no liability for items left behind in the vehicle. The customer is obliged to check their personal items when leaving the vehicle.
19. Payment
Payment is made in Euro. The following payment methods are accepted:
Credit card
EC card
Invoice (for verified business customers) Unless otherwise agreed, payment is due immediately after completion of the journey.
20. Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies. If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the registered office of Andreiver. For consumers within the European Union, mandatory consumer protection regulations of their state of residence remain unaffected.
The contract language is German.
